TLTA Submits Comments on Final Round of CFPB Proposed Forms
Texas Economist, TLTA Share Concerns
TLTA submitted comments earlier this week on the final round of the CFPB's proposed rules integrating the RESPA/TILA mortgage disclosure and settlement forms. Included with our comments to the CFPB was a letter from Texas economist Jared Hazleton, Ph.D. who, along with TLTA, shares concerns that the proposed rules could cause lenders to vertically integrate with settlement service providers, potentially greatly reducing the role and presence of smaller title agents. TLTA has shared these concerns in previous letters to the CFPB in addition to a Small Business Review Panel last month, which you may read more about here. We expect the CFPB to formally issue a proposed rule sometime this summer and we will keep you updated on their progress.
Texas Rep. Burt Solomons Seeks Clarification to Tax Lien Lender
Last week a request for opinion was filed by Texas State Representative Burt Solomons seeking an opinion regarding the authority of a tax assessor-collector to transfer a taxing unit's tax liens and the scope of the transferred lien under the Texas Tax Code. The first question deals with the authority of the tax assessor-collector to effect a valid transfer of lien. The request also covers the question of whether the property tax lender's fees and interest, post-transfer, should be treated as a "priority lien." You may view the Request for Opinion here.
