Texas Supreme Court Rules on Deed Mistakes and Statute of Limitations

Decision preserves the integrity of the statute of limitations for recorded deeds

The Texas Supreme Court recently decided a case addressing the applicability of statute of limitations when there is an "obvious omission in an unambiguous deed." The Court held that the parties to a recorded deed are charged with actual knowledge of the contents of the deed at the time of execution as a matter of law and that the statute of limitations runs from that date, thus barring any application of the discovery rule.

This case, Cosgrove v. Cade, reemphasizes the need for doc prep counsel to prepare documents with both the contract and commitment in hand. It also highlights the importance of a post-closing review to compare the deed, deed of trust and policy for consistency with the contract or loan documents.

TLTA's 2015 Annual Conference & Business Meeting a Huge Success!

The 2015 Annual Conference and Business Meeting was a huge success! Held June 18 – 20 at the Gaylord Texan in Grapevine, 425 attendees came for a series of educational opportunities, interesting speakers, networking and fun social activities. This year’s conference featured the optional pre-conference TRID Readiness Series, Part 2 with over 275 attendees. Be sure to download the presentations from two of our Opening Session presenters. Tom Rutledge Awarded Honorary Member 
for Meritorious Service to TLTA 

The TLTA Board of Directors unanimously voted in the fall to name long-time TLTA Counsel, Tom Rutledge, an Honorary Member for Sustained Meritorious Service. Tom recently retired from Sneed, Vine in Austin after 35 years and he served as TLTA Counsel for almost 30 of those 35. Tom will join his mentor and partner at the firm, Robert Sneed in this distinguished group.

“Tom’s love of the law and his respect for it coupled with his unquestionable integrity have earned him a sterling reputation among his peers and colleagues,” said Leslie Midgley, TLTA Executive Vice President and CEO. “As his client, TLTA was the lucky beneficiary of that reputation.
