TDI Publishes 2023 Agent Experience Report

The Texas Department of Insurance published their Title Insurance Agent Experience Report Compilation for 2023.

Texas Insurance Code §2703.153 requires each title insurance company and title insurance agent engaged in the business of title insurance in Texas to annually submit business data to TDI. TDI uses this data to set title insurance premium rates.

The new agent experience report was completed with data generated during calendar year 2023.

Texas Legislature 89th Session Update: Senate Passes Statistical Report Deadline Bill

Less than 47 days remain in the Texas Legislature's 89th Session. Floor activity continues today, committee hearings will be held tomorrow, and then both chambers will adjourn for the holiday weekend.

Texas Senate passes SB 1810 re: TDI deadlines for submission of title insurance statistical data. This legislation is among the bills on TLTA's affirmative legislative agenda for the 89th Session

Title insurance rates in Texas are determined based on financial and statistical data submitted annually by title insurance agents and companies. Sen. Schwertner's SB 1810 would provide for timely and accurate data collection by mandating clear deadlines for the Texas Department of Insurance (TDI) to issue data calls and publish statistical reports. Earlier this week, the Texas Senate passed SB 1810, and it has now been sent to the House for consideration. Thank you to Sen. Schwertner and the entire Senate for passing this important legislation. We look forward to working with the House to win their approval too. Rep. King's companion bill (HB 3502) is scheduled for hearing in the House Insurance Committee tomorrow, Thursday, April 17.

FinCEN Renews Residential Real Estate GTOs

The Financial Crimes Enforcement Network (FinCEN) announced the renewal of its Geographic Targeting Orders (GTOs) that require U.S. title insurance companies to identify the natural persons behind shell companies used in non-financed purchases of residential real estate.

The terms of the GTOs are effective beginning April 15, 2025, and ending on October 9, 2025. 

No changes have been made to jurisdictional coverage since the last issuance of these GTOs. The following Texas counties continue to be included in the GTO: Bexar, Dallas, Harris, Montgomery, Tarrant, Travis, Webb.

FinCEN adopted new rules related to reporting requirements for certain all-cash residential real estate transfers, which will replace the current GTO program referenced above on Dec. 1, 2025.
