Texas Legislature's 88th Session Commences This Tuesday, Jan. 10; New Bills Added to TLTA's Bills of Interest List

The Texas Legislature's 88th Session commences this Tuesday, Jan. 10, and prefiling of legislation for the session continues.
Since our last legislative update on Dec. 14, we added new bills to our
2023 bills of interest list. In addition to pursuing passage of our industry's affirmative legislative agenda—which will be approved by TLTA's Board of Directors later this month—TLTA's legislative team reviews all bills filed during the session and monitors those that might impact our industry or the state's real estate marketplace.
We will maintain the bills of interest list throughout the legislative session, adding new bills of interest as they are filed. If these bills begin to move through the process and TLTA takes official positions on them, we’ll provide more detailed information about our stance and how they might affect you and your business.

Establishing and maintaining effective lines of communication the lawmakers who oversee our regulated industry is a top priority for your TLTAPAC and advocacy team. When the new session commences in January, it will be important to make sure these new legislators hear our industry's story directly from the mouths of their constituents.

New Property Tax Law Effective as of Jan. 1; Other New Laws in Effect for 2023

In May of 2022, Texas voters approved an amendment to the Texas Constitution that extends the school property tax rate cuts approved by the Texas Legislature in 2019 to elderly and disabled homeowners. This change is effective as of Jan. 1, 2023.
The constitutional amendment was sent to Texas voters for final approval after lawmakers passed it during the second called session of the 87th Texas Legislature in 2021 via
SB 12 (SJR 2).
Other new laws also went into effect on Jan. 1.

TDI's Annual Report for FY 2022

The Texas Department of Insurance posted its Annual Report for FY 2022 on Dec. 27.
Title insurance was mentioned in the report as follows:
- Description of duties of the Fraud Unit and what they investigate (pg. 15)
- Table describing how the maintenance tax paid by underwriters compares to other lines of insurance (pg. 43)
- The number of licensed title agents over 5 years (pg. 44)
- The number of title examinations conducted (pg. 46)
- Texas Guaranty association assessments by year (pg. 47)
- Title companies in receivership for rehabilitation or liquidation at the end of FY 2022 (pg. 51)
