Informal Public Meeting With TDI Dec. 16 to Discuss Title Insurance Rulemaking

TDI has scheduled an informal public meeting regarding title insurance rulemaking Dec. 16 at 9:30 a.m. TDI's regulatory team will be discussing their proposals, as well as industry supported proposals from TLTA. 
 
It’s important to note that this is not a hearing, it's just an opportunity to explain the items and the background on each and answer questions anyone may have. These meetings are informal and offer all parties, as well as anyone form the public who is interested, a chance to participate in the process. 
 
The goal is to work through any concerns in advance of a formal hearing. No formal hearing has been scheduled at this time.

TDI Biennial Report to 88th Texas Legislature

The Texas Insurance Code requires TDI to submit a report to the Texas Legislature before every legislative session recommending changes in law regarding the insurance lines TDI regulates and other agency responsibilities.  
 
This year's report contains one title insurance-specific recommendation:
 
Amend Insurance Code 2651.151 to allow electronic submissions of audit reports.

Lt. Gov. Announces Texas Senate Priorities for Session

Lt. Gov. Dan Patrick on Wednesday unveiled a list of 21 legislative priorities including property tax relief.

Prefiling Continues

Texas Legislature's 88th Session commences Jan. 10, 2023, and pre-filing of legislation for the session continues.
 
Since our last legislative update on Nov. 16, we've added two bills to our 2023 bills of interest list. In addition to pursuing passage of our industry's affirmative legislative agenda—which will be approved by TLTA's Board of Directors in January—TLTA's legislative team reviews all bills filed during the session and monitors those that might impact our industry or the state's real estate marketplace.
 
We will maintain the bills of interest list throughout the legislative session, adding new bills of interest as they are filed. If these bills begin to move through the process and TLTA takes official positions on them, we’ll provide more detailed information about our stance and how they might affect you and your business.

Underwriter Data Call Due to TDI Today, Dec. 5

The Texas Department of Insurance (TDI) issued this mandatory data call under Insurance Code Section 2703.153, which requires title insurance underwriting companies to submit data to TDI annually. TDI uses this data to set title insurance premium rates, as required by Insurance Code Section 2703.151. This data call requests income, expense, and policy data from calendar year 2021.

FinCEN's Expanded GTO for Harris, Montgomery and Webb Counties Went Into Effect Nov. 25

The Financial Crimes Enforcement Network (FinCEN) recently announced the renewal and expansion of its Geographic Targeting Orders (GTOs) that require U.S. title insurance companies to identify the natural persons behind shell companies used in non-financed purchases of residential real estate.  
 
FinCEN expanded the geographic coverage of the GTOs to Harris, Montgomery and Webb counties. This change when into effect Nov. 25.
 
FinCEN also renewed the GTOs that cover Dallas, Tarrant, Bexar counties and other major U.S. metropolitan areas. That renewal was effective as of Oct. 27.
