Executory Contracts

The goal of this course is to familiarize attorneys, paralegals, settlement agents and title professionals with the history and current use of executory contracts in Texas. Upon completion of the course, attendees should have a general understanding of the following:

  • Terminology used by buyers, sellers and realtors regarding the structure of a sale transaction
  • The ways in which executory contracts differ from typical Note/Deed of Trust transactions
  • The rights parties have during different stages of a executory contract
  • Duties of the seller/lender before and after execution of a executory contract
  • How to cure ownership by the grantee and the loan by the grantor
  • Determining whether a particular transaction can be insured under an owner’s or loan policy
  • And more
